PREAMBLE

1. These general sales conditions are agreed upon between Life in a bag Lda, located at Rua Fernando Pessoa, 115, store 7, 4760-144 Vila Nova de Famalicão, tax identification number 514585404, and contact number +351 252 312 427, hereinafter referred to as "Swallows," and individuals wishing to make purchases through the website www.swallows.pt, hereinafter referred to as "User."

2. The parties agree that purchases made through the website www.swallows.pt will be exclusively governed by this contract, excluding any conditions previously available on the website.

ARTICLE 1 – OBJECT

1. The purpose of these general sales conditions is to provide and define all necessary information to the User regarding the ordering, selling, payment, and delivery modalities for purchases made on the website www.swallows.pt.

2. These conditions regulate all necessary steps to place an order and ensure the follow-up of this order between the Contracting Parties.

ARTICLE 2 – ORDER

1. The User places their order by completing the purchase process presented on the website www.swallows.pt, adding the product(s) or service(s) they wish to order to the shopping cart:

2. To submit their order, the User must: Complete the information and choose the options provided throughout the order finalization process (delivery and billing address, payment method, as well as the tax identification number and name they wish to appear on the invoice for tax purposes).

3. The User's final confirmation of the order equates to full and complete acceptance of the prices and descriptions of the products available for sale, as well as these General Sales Conditions, which will be the only ones applicable to the contract thus concluded.

4. Swallows will honor orders received online only up to the limit of available stock. In the event of product unavailability, Swallows commits to inform the User as soon as possible.

5. The information on the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.

6. Order requests are valid for 10 (ten) days, unless the order is registered under a promotional campaign that defines a different timeframe, and it is not possible to guarantee prices, discounts, promotions, and offers beyond this period. If payment is not received by our services within the specified timeframe, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

ARTICLE 3 – PAYMENT

1. On the website www.swallows.pt, Swallows offers the User the following payment methods:

a) PayPal;
b) Multibanco Reference;
c) Credit card (Visa, Mastercard) via PayPal;
d) Bank transfer.

In the case of payment by credit card or PayPal, the charge will be made to the User's card immediately after confirmation of the shipment of the goods. If some ordered products are out of stock, their value will be credited back to the User's card after the order is closed.

ARTICLE 4 – DELIVERY

1. Orders will be delivered within 5 business days after the order is placed. Delivery is carried out by CTT, GLS, or UPS.
2. If no one is present at the delivery address, a notice will be left for collection at a pickup point.
3. Shipping costs will be added to the order, as indicated at the end of each order.

ARTICLE 5 – PRICES

1. Prices are understood in Euros, including taxes and fees, taking into account the VAT in effect at the time of payment of the order.
2. In the event of a price increase for any product, the User will be informed immediately and may choose to receive their order (by paying the difference) or to cancel it.

ARTICLE 6 - WARRANTY

1. The User is responsible for the results of germination and growth. This depends on various factors, such as temperature, watering, and light. Swallows cannot be held responsible for the failure of seed germination.


ARTICLE 7 – CANCELLATION AND RETURN

1. If the User wishes to return their purchase, they may do so within 14 days from the date of receipt of the order.

2. The return request must be sent in writing to the email info@swallows.pt.

3. Returned products must be in sellable condition, meaning in the same state as when they were received by the User, without any anomalies or damage.

4. The costs of returning the products will be the responsibility of the User.

5. The refund of the purchase amount will only be made after confirming the good condition of the products and will always be done via bank transfer.

6. Only the amount corresponding to the product(s) will be refunded, and shipping costs will not be refunded.

ARTICLE 8 – PRIVACY POLICY

Processing of your data is carried out in compliance with legislation on the protection of personal data. The data, subject to computer processing, will be included in Swallows' database(s) and are intended for the registration and presentation of other products and services, as well as institutional information to be provided by them.

Providing your data is optional, and the right to access, rectify, and cancel any data directly concerning you is guaranteed by law, either in person or in writing, directly to the address listed on the homepage of this website.
